New labour laws from July 1! How working hours, PF and in-hand salary will change

The Central government is planning to implement new labour laws from July 1, 2022. If this gets implemented, then there will be a significant change in office working hours, employee’s provident fund (EPF) contributions and in-hand salary. While the office hours and PF contributions are likely to increase, the in-hand salary will likely decrease.

The government is working to implement a set of four new Labour Codes as soon as possible. The government is of the opinion that the new labour laws will boost investments in the country and increase employment opportunities.

The newly enacted Labour Codes lay down an array of reforms relating to wages, social security (pension, gratuity), labour welfare, health, safety and working conditions (including that of women).

Changes if new labour law comes into force?
1. If the new labour laws are implemented, then this will allow companies to change the office working hours significantly. They can increase the office working hours from 8-9 hours to 12 hours. But they will have to compensate their employees by giving them three weekly offs.

The idea is not to alter the total working hours in a week.

2. Additionally, the maximum number of overtime hours for workers has been increased from 50 hours (under the Factories Act) to 125 hours (in new labour codes) in a quarter across industries.

3. There will be a significant change in the take-home salary component and employers’ contribution to the provident fund. The new codes may put the employee’s basic salary at 50% of the gross salary. It will increase the PF contributions of the employee and the employer. The take-home salary will decrease for some employees, especially those in the private sector.

4. The money received after retirement and the gratuity amount will also increase. This will enable employees to lead a better life after retirement.

5. The government has also aimed to rationalise the leave a worker can avail during the course of his/her employment, carry forward of leave to succeeding year and encashment of leave during the tenure of employment. The new Labour Codes have reduced the eligibility requirement for leaves from 240 days of work to 180 days of work in a year.

However, the quantum of leave earned will remain unchanged, that is 1 day of leave earned for every 20 days of work. Similarly, no change has been proposed in the limit on carry of forward of leaves which remain at 30 days.

6. Work From Home (WFH) which is a prevalent market practice across sectors specially after the outbreak of the covid-19 pandemic, has been recognised by the central government in the draft model standing order applicable to the service industry.

7. So far, 23 states have reportedly framed labour code rules. The other seven have not yet. The parliament has passed these codes.

Gokhale Education Society was founded on 19th February 1918, on the third death anniversary of Namdar Gopal Krishna Gokhale, by his illustrious disciple late Principal T.A. GES‟s R. H. Sapat College of Engineering, Management Studies and Research, Nashik was established in 2009 and is affiliated to SPPU, Pune. The Women Empowerment and The Accountability.

There is a bidirectional relationship between economic development and women empowerment defined as improving the ability of women to access the constituents of development in particular health, education, earning opportunities, rights, and political participation. In one direction, development alone can play a major role in driving down inequality between men and women; in the other direction, continuing discrimination against women can, hinder development.

Empowerment can, in other words, accelerate development.

Policymakers and social scientists have tended to focus on one or the other of these two relationships. Those focusing on the first have argued that gender equality improves when poverty declines. Policymakers should therefore focus on creating the conditions for economic growth and prosperity, while seeking, of course, to maintain a level playing field for both genders, but without adopting specific strategies targeted at improving the condition of women.

In contrast, many emphasize the second relationship, from empowerment to development. The United Nations resolution has argued that achieving gender equality is a “prerequisite” to achieving the other Millennium Development Goals (MDGs), including eliminating poverty, reducing infant mortality, achieving universal education, and eliminating the gender gap. In its report, “Engendering Development,” the World Bank
called for policies to address gender imbalance in “rights, resources, and voice,” and recommends that institutional structures be overhauled to promote equality, and that specific measures, be adopted and emphasise the “business case” for women empowerment, it mainly takes it as given that the equality between women and men is a desirable goal in itself, and policies should aim to achieve that goal.
